In 2011 I was arrested for suspected DUI in Moody, AL. I retained Mr. Guy C. McCombsâs III as my legal representation because he came highly recommended among the community. I talked with him several times and met with him in his office once before court. He assured me that my case would be dismissed, stating that he personally knew the judge and have had thousands of DUI cases that all get dismissed.
On the day of my court, I was again reassured by Mr. McCombâs that my case would be dismissed. Upon entering the court room there were several cases ahead of mine, after a few minutes I was called up for my case. Mr. McCombâs talked with the judge privately and then brought me a few documents to sign. He stated that my case was dismissed and I had nothing to worry about. After signing all the documentation we both walked out of the small courtroom. He again reassured me that everything had been dismissed and we both parted ways, and I was relieved.
I never lost my license, never had community service, never had color code and had never had court referral.
Fast forward to 2023, Iâm in the music touring industry and we have to sometimes go into Canada. Canada doesnât approve of DUI convictions and usually refuses entry for anyone with one on there record.
In January of 2023 knowing that I will possibly be entering Canada soon (May of 2023) I called to check on my record and it showed a DUI arrest, but I have not been to court yet according to ALEA (Alabama Law Enforcement Agency) 12 years later.
I immediately called Mr. McCombâs and told him my situation, at that time he remembered my case, and stated that the judge or clerk must have not sent in the dismissal form to ALEA. He reassured me that he would call and get it taken care of ASAP.
Finally after 2 months I called ALEA back and was checking on the status of the dismissal. The person said it was now a Guilty Plea. I immediately called Mr. McCombâs and told him it was now a Guilty Plea and the judge never sent in the dismissal form. He again reassured me he would call the judge and get him to send the form to ALEA in Montgomery, AL.
Several hours later he called me back and was stating that it was a Guilty Plea and he couldnât do anything about it. I expressed my amazement and he asked if I had any paperwork (which I was never given anything during or after court. I had also surrendered my ticket and paperwork to his law clerk when I retained him as my legal representative.) I immediately asked if he could send me my file and all the paperwork in which he repliedâŚâI destroy all my paperwork, so I have no record of your case.â After almost an hour arguing with him on the phone, which he was very rude and demeaning, I finally ended the conversation.
I suggest that the Alabama State Bar Association should investigate Mr, Guy C. McCombâs III law and business practices. Files for current and closed cases should be inventoried and kept for future reflection purposes such as this. Many cases have been reopened years after judgement and rulings overturned. I believe Mr. McCombâs is withholding valuable paperwork or has destroyed such paperwork to withhold evidence of his shortcomings.
