After several long years of a very bitter and contentious battle, Judge Kahn helped us to reach an end to our dispute. I truly believe his thorough preparation and forethought was the key to guiding us to an agreement. We had tried an earlier mediation where I felt the judge was not familiar with the case, the process, nor the individuals he would be working with during the mediation. I’ve had two occasions to work with Judge Kahn as a mediator. Both cases had significant factual disputes and many grey areas in the law. The legal costs and fees to do these cases properly would have been prohibitive. In both cases, the parties were so far apart that if there was going to be resolution, it could only be accomplished with the assistance of a very skilled mediator.

Many mediators, especially retired judges, can size up the facts, weigh the credibility of the witnesses, isolate the issues and give an opinion as to what a judge/jury would do at trial. Judge Kahn can do all the above. What distinguishes Judge Kahn from others is that he has a very unique ability to gain the confidence of the most stubborn, unreasonable and difficult parties. Such an ability is often needed to obtain settlement.

Judge Kahn’s fee arrangement is extremely fair. Judge Kahn also goes the extra mile by meeting with the parties beforehand so he has a very good grasp of the case and the position of the parties/lawyers before the mediation starts. If you are doing a mediation merely to comply with a scheduling order and allowing one and a half hours, Judge Kahn is not your person. If you have a challenging case that needs resolution, Judge Kahn is the man.

I represented one of 4 siblings engaged in a bitter family dispute. The case sprawled across 2 separate lawsuits. The case had been going on for 3 years. The case had been unsuccessfully mediated a year before. (For me, success is the resolution of the dispute acceptable to the parties and the end to ongoing litigation.) A new judge ordered us back to mediation before Judge Kahn. I was opposed. The parties had demonstrated they would never resolve their differences. This case would not be resolved though mediation. I was wrong.

Judge Kahn started by meeting one-on-one with each participant a few days before the mediation. No other mediator I have worked with has done this. This allowed Judge Kahn to really know the participants before the day of mediation.

There is no question that Judge Kahn is well versed in the law. But he also brings "soft skills" to the mediation table that are not often found among those of us trained solely in the law. He brings an empathetic understanding of the human condition and human nature to the mediation which allows him to craft a resolution where the parties are even just the least bit willing to end their dispute.

My client spent a lot of money on litigation prior to mediating with Judge Kahn. She would have spent a lot more if the mediation had not been successful. "Success" is often in the eye of the beholder. In my client's eyes the mediation was a success. I deem the mediation a success as well due to the unique skills Judge Kahn brought to the table.
